PIP reform bill filed - would limit attorneys fees

This first bill to reform personal injury protection (PIP) insurance in Florida has been filed for the 2011 Legislative Session.  HB 967.  Among key provisions, the bill would:
  • Limit the amount of one-way attorneys fees recoverable by the plaintiff to the lesser of $10,000 or three time the disputed amount recovered.
  • Eliminate the contingency fee multiplier from statutory one-way plaintiff attorneys fees.
  • Provide for arbitration of disputed PIP claims under new statutory procedures.
  • Require the insured and its assignees to cooperate under terms of the policy, including participation in examinations under oath.
