Can OIR prohibit use of public adjusters?

A lawsuit has been filed in Tallahassee, Florida circuit court, challenging the authority of the Florida Office of Insurance Regulation to approve form filings allowing  insurers to prohibit policyholders from hiring licensed public insurance adjusters as a condition of insurance coverage. 

In the complaint, filed by the National Association of Public Insurance Adjusters and the Florida Association of Public Insurance Adjusters, the PA trades associations claim that the OIR does not have the authority to prohibit policyholders from using public adjusters.  To see the complaint, go to the following link:  http://www.courthousenews.com/2011/03/10/Insure.pdf.
